Family Sponsored Immigration

Family sponsored petitions are numerically controlled and processing may take several years.  In addition to the numerical limitations, there are limits on the number of immigrant visas per year which can be issued to natives of any single country.

Whenever there are more qualified applicants for a category than there are available numbers, the category will be considered oversubscribed and immigrant visas will be issued in the chronological order in which the petitions were filed until the numerical limit for the category is reached. The filing date of a petition becomes the applicant's priority date. Immigrant visas cannot be issued until an applicant's priority date is reached.

A US citizen sibling or parent or a US legal permanent resident parent or spouse may file a family based petition. Grandparents, aunts, uncles, in-laws and cousins cannot file a petition for a relative for immigration.

• Unmarried Son or Daughter over the age of 21 of a U.S. citizen
• Spouse or Unmarried Son or Daughter of a Lawful Permanent Resident (LPR)
• Married Son or Daughter of a U.S. Citizen
• Brother or Sister of a U.S. Citizen: U.S. citizen must be 21 or over

Family sponsored petition can only be filed with the US Citizenship and Immigration office in the United States http://www.uscis.gov.
